What is co-ownership?
If you have co-ownership of a house or other property, you own it jointly with one or more other owners. Each of you can dispose of a certain fraction. In principle, this is referred to as ideal co-ownership shares, as it is often not possible to divide the property into real fractions. For example, if you own half a house, you cannot simply cut the property in half. The same applies to half a flat or half a plot of land. Your half co-ownership share is therefore only non-material. This often leads to difficulties in handling.
The difference between co-ownership and part ownership
Even if it looks like it at first glance, the terms co-ownership and part ownership do not mean the same thing. Partial ownership is a special form of residential property. The term is used when the proportionate ownership of rooms involves commercially utilised units. Restaurants, surgeries, business premises or workshops belong in this category. Flats or flats, on the other hand, are residential property. This is also known as separate ownership, as the owner not only owns a flat, but also a share of the property in which the residential unit is located. This in turn is to be distinguished from residential property, which is characterised by the fact that a purchased flat is also occupied by the owner. You only own part ownership if you are a co-owner of a commercially used unit.

WAS MUSS ICH BEIM VERKAUF VON MITEIGENTUM BEACHTEN?
Sie müssen beim Verkauf von Miteigentum zum Beispiel beachten, ob Vorkaufsrechte von Miteigentümern vereinbart sind. Insbesondere finden Sie dazu Informationen in der Teilungserklärung, wenn es sich um Wohneigentum handelt.
Weitere Vorkaufsrechte können im Grundbuch verankert sein. Von großer Bedeutung können Benutzungsregelungen oder Beschränkungen für die Auseinandersetzung nach § 1010 BGB sein. Ein weiterer Aspekt, der berücksichtigt werden sollte, ist wenn es sich beim Veräußerer um einen Ehepartner und bei ihm um einen Großteil des ehelichen Vermögens handelt. Hier besagt § 1365 Abs. 1 BGB, dass nur mit Einwilligung des Ehepartners, über das Vermögen im Ganzen verfügt werden kann. Last but not least sind Belastungen im Grundbuch sowohl in Abteilung 2 als auch in Abteilung 3 ausschlaggebend für den erfolgreichen Verkauf Ihres Miteigentumsanteil.
