FAST, UNCOMPLICATED AND DIRECT
All members of a community of heirs are referred to as joint owners. A key feature of this community of joint owners is that individual members of this community cannot dispose of their inheritance share (according to inheritance quota). Decisions regarding the estate must be made jointly by all co-heirs, regardless of the size of their respective inheritance shares. Only then is it possible to sell the inheritance.
CONFLICTS IN THE COMMUNITY OF HEIRS FOR YOUR HOUSE
Particularly in the case of an immovable inheritance, i.e. an inherited house, only the community, but not the individual, can dispose of it. If the deceased was only a co-owner of a property, the situation is different. As a result, the heirs are referred to as a fractional community. This in turn is characterised in the land register by a respective fraction (e.g. 1/2) and is to be seen as a non-material share in the property §§1008 ff. This situation often leads to disputes within the community of heirs. These in turn can lead to considerable costs, a high expenditure of time and emotional strain. Only very few people realise that the consent of the other parties is not required for the sale of these shares. According to the German Civil Code, everyone is free to decide whether they want to leave the community of owners, for example through an inheritance sale.
WHAT DOES INHERITANCE DIVISION MEAN?
Once the co-heirs in a community of heirs have completely divided up the estate, the community is dissolved. This division is known as the distribution of the estate or division of the inher itance. In principle, every co-heir has the right to demand the division of the estate at any time. There are various ways to dissolve the inheritance in this way. One option is for one co-heir to pay out all the others. However, everyone must agree on this. If only one person wishes to sell their share of the house, they can sell their share of the inheritance without the consent of the others. All rights and obligations relating to the estate are then transferred to the buyer.
SELLING A SHARE OF THE ESTATE - PREREQUISITES
In principle, the consent of the co-heirs is not required for the sale of one's own inheritance share in a house. However, a share in a property can only be sold once a partition plan for the division of the estate has been drawn up. The following points must also be fulfilled for the division of the inheritance.
